Keeping The Vigil

About two dozen spectators, mostly family members and supporters of the defendants, spent the afternoon camped in the hallway outside Courtroom 15A.

Meanwhile, behind closed doors, the jury in the rogue cops case sent two questions to Judge Eduardo C. Robreno that prompted some sparring among the lawyers.

"Hey, hey, hey," the judge yelled at the lawyers, to get them to calm down.

The first jury question on the second day of deliberations asked if all the charges in the case are interrelated, or whether they all stand alone.

The second question involved Episode #17 of the indictment, where Officers Thomas Liciardello, Brian Reynolds and John Speiser allegedly stopped a person identified as "L.S." near 38th St. on Aug. 14, 2010, and confiscated a total of $1,100 in cash.

The indictment charged Liciardello with attempting to "conceal the theft from authorities" by writing a police report that said only $507 had been seized from L.S. "To conceal the theft of the additional $593 from L.S., defendant Liciardello falsely stated in the report that Jeffrey Walker had made an undercover purchase of Endocets from L.S. when Liciardello knew that was not true," the indictment stated.

L.S. would appear to be drug dealer Leonard Sammons. On April 23, Sammons was unsteady on his feet and reeked of alcohol when he strode to the witness stand to testify on behalf of the government.

Sammons told the jury that in August 2010, he drove out to the Hess Gas Station at 34th and Grays Ferry carrying 182 Percocets and $1,100 in cash. At the time he was driving, Sammons told the jury he had also been drinking a half pint of Grey Goose vodka.

That's when he was accosted by the defendants, Sammons testified.

"They told me to get the fuck out of my car," Sammons said.

Licardello, Sammons said, put him in handcuffs. Then, Officer Walker swore out a false statement that claimed he had bought 182 pills from Salmons for $600, Sammons told the jury.

When he saw a mug shot in court of Officer Walker in dreadlocks, Sammons shouted, that's the guy. "I never sold to him in my life."

When the jury filed into the courtroom today, the judge told them, "I have your questions."

On the first jury question of whether the charges in the case are interrelated or do they stand alone, the judge referred the jury to three different paragraphs in his written instructions.

The paragraphs, which the judge read out loud, said that the charges in the rogue cops case proceeded from an alleged RICO conspiracy, although in the indictment, individual defendants are also charged with individual offenses.

The number of charges against any one defendant has nothing to do with the relative guilt or innocence of the defendant, the judge said. The judge instructed the jury to consider each charge separately, and he reiterated that every charge had to be proved beyond a reasonable doubt.

Regarding Episode 17 and the charge of attempting to conceal a theft from authorities, the judge said Liciardello would be guilty if the jury found that the officer wrote a false report that said a phony amount of cash had been seized from the drug dealer.

Liciardello would also be guilty of attempting to conceal a theft if the jury found that the officer had falsely stated that Walker made the undercover buy if Liciardello, who never took the stand, knew it wasn't true.

"Either is sufficient," the judge said, if the jury found that Licardello had committed either act "with intent to impede the investigation."

Besides the legal questions, spectators were left to ponder the jury's demeanor.

During closing arguments, some jurors had glanced at family members in the spectator seats. Some jurors at times were also observed dabbing their eyes during emotional closing statements from a half-dozen impassioned defense lawyers.

Today, however, the jury seemed to be all business and kept their eyes riveted on the judge.

The jury sent another note to the judge saying they wanted to go home at 4:30 p.m.

When he dismissed the jury for the weekend, the judge said that deliberations would resume at 9 a.m. Monday.

  5. if there were referees out there in the street of cops and drug dealers,Tommy and the five crooked cops would have been penalized so many times.the referee would have thrown the flags so many times, because you do not lock up drug dealers steel the money, jewelry,and show up for court for the overtime give the drug dealer a lot of time in jail, that's a foul,the rules are you do not show up in court, keep the money and drugs, but No, tommy was too greedy, he knew watching him, in my world that is the time to stop, but the greedy f*** with his legitimate cops pay, it was making a hundred thousand a year,if Tommy had a friend and he does not. his friend would have went to him and said cool it the feds are watching ,but no use people like the money,somebody should have a sit down with them

    1. I'm not sure what there is to explain? If an informant or a drug dealer does not set up another buy for the police, then the drug dealer goes to jail. If the buy happens and their supplier gets arrested, the informant gets off because they gave up someone else. In this case, the drug dealers are making false accusations because they want the amount of money they receive from their civil suit to triple so they need to have the officers found guilty. The drug dealers actions are only done to help themselves.

One is everything was recorded times documented on drug buys with info from the snitch.s and evidence seized and before any one used info from the snitch.s it was all checked out so they weren.t in danger during surveilance and drug buys. As for these snitch.s they made a deal when approached by the feds because someone had a hard on for these 6. Then in the 6 yrs of federal investigation they got nothing but storys that both the feds desperately tried to rehearse but these idiots could.nt remember the stories. So they made up there own based on there rights were violated and money taken so on and so on. But yet they were still convicted . If these idiots rights were violated why were there cases not thrown out i can go on and on.
    But you don.t wanna here the truth.So ill tell you a lie instead when these guys get found Not Guilty you.ll be set free and your sentences terminated. Oh ya those other dealers you Snitch.ed on there ok with that no repercussions forswting them up.

  16. Having followed this entire trial, I believe these cops are guilty. Not to say the witnesses are innocent, they are all scum and guilty as well. That being said, it does not give the cops the right to steal from them and for that they belong exactly the same place those drug dealing low lifes are. I feel sorry for the cops that go out and risk their lives to protect people like myself and my family everyday that get a bad rap due to the greed of these 6 men that couldn't keep their hands out of the cookie jar.

  24. Well trial is over except for verdict. And everybody wants change in the PPD. See Narcotics is just one of many divisions in the ppd. To blame these 6 for the problems in the departmemt is ludicrous. It goes way beyond them. The problem starts from the top. You have brass that have been in charge for many yrs. And the gap between new recruits and old officers is huge. But the things that worked on the street in the old days don.t work today. The safety issues are the same if not better but the bosses don.t go to seminars to familiar them selves with new technology. But there street smarts for hrs on the job are priceless. The patrol officers if they follow proper protocol they.ll be ok. The problem is chain of command you have antiques who are in position because of Seniority and all they worry about is numbers and politics no matter what division your in. Start pushing for more numbers the gray area gets a little more cloudy and you end up policing the police instead of yhe crooks. What nerds to happen is change at the top starting with the commissioner . I don.t agree with politics in police work but thats my opinion. Start with commissioner Charles Ramsey and his cronies. Then you hire from within the Police dept because they care about the city and know the problems and the trouble areas and what the people want. What it say when fine police officers can take the hits and the bullshit that goes with it but aren.t good enough to hold the title of Commissioner in the city they work. I say thats bullshit im sure there are several qualified Gentlemen to hold that honor. And once he.s chosen then he cleans house and picks his staff. The others resign or get dismissed. If the union don.t like it you replace them with those who do. Its not perfect but you gotta start some where

    Listen...if tommy and his crew broke the law they then the jury will find him guilty. And if the 6 ex narcs did not break any law they will be set free. But why as humans do we come to hate each other over difference of opinions?
    We stoop to calling each other racial slurs and whats obvious is no one (im guessing) on this blog are the ones facing jail time although some here claim to have been victims. God is good and the God i believe in is merciful and just as forgiving. So lets pray for all to turn out well for both sides.

I agree and well said, however think it's more the nature of some peoples options on this site and the reasons behind their options, it gets annoying to see people writing GUILTY GUILTY GUILTY when it's clear by their comments that their option is strictly based on their relationship with these men and not the actual facts of the case, someone's not guilty of theft and kid napping, robbery and lying just because they caught me selling Drugs and sent me to jail, or because they are a better cop then I could ever be so I'm jealous -Everyone of course is In Tilted to their own options and of course some of us can get carried away defending whatever side we feel we are on in this case I do agree that God is good and that the truth will come out of this case by its verdict. In my eyes that verdict would be hands down NOT GULITY across the board.

    5. This tommy was a scrawny little picked on closet fag from the time he was a kid. Anyone that knew him growing up would agree. He thought becoming a cop wouled erase all those memories of sitting on his step like a girl when all the kids were playing ball up Sartain street. He became a dirty cop like his dad was, the whole neiborhood knew he was dirty too. I guess it was different being dirty under rizzo than it is now a days. He's absolutly guilty. Officers in the New York City police and New York State police departments were convicted of falsifying drug evidence”  Heads of these agencies were later czar and chief of the Drug Enforcement Agency(McNamara, Joseph. “Why cops lie about drug evidence”).  Corruption in the police force is not a new topic of discussion.  It has been around since the beginning.  To look only seventy years back into the 1920s and the 1930s, one can see many incidents of police looking past prohibition violations for a payoff.  Officer Frank Serpico’s New York Department was involved in falsifying drug evidence and it went unchecked until Officer Serpico testified for the Knapp Commission.  In his last few statements, he cautioned the commission that the only way to prevent police corruption was to have an ever-present commission looking over the shoulders of local departments.  They did not heed his words and now we are in the height of police corruption. “Reuter News Service reported in December 1994 on the latest charges of police abuse in New Orleans, Louisiana.  Nine New Orleans police officers were arrested…and charged with protecting the storage and movement of more than 130 kilograms of cocaine…In exchange for their protection they were paid in excess of $97,000 in bribes”(“Nine Cops Indicted in New Orleans,”  Reuter News Service)

Imagine for a minute, a fifty-three-year old African-American grandmother of a suspected murderer, sitting in her house knitting.  Two police officers knock on her door to ask about her grandson.  She lets them in to tell her what she knows, like any law-abiding citizen.  Ten minutes later she is being led out to the police car in handcuffs.  She was arrested for possession of controlled substances.  Now fast forward three years when she is being released because it has been discovered that the very officers that knocked on her door planted the drugs in her home.  When asked why this woman was a target, the officers replied that they were trying to get to her son.  This happened to fifty-three-year old Betty Patterson in Philadelphia, Pennsylvania.  She was released in 1994.  “From 1988 to 1991, a group of four policemen in Philadelphia’s 39th district stole $100,000 from drug dealers and sent innocent people to prison”(“It was the ‘day of judgment’ for rogue cops in Philadelphia,” Associated Press). These officers, John Baird, Thomas DeGovanni, Thomas Ryan, James Ryan, and Steven Brown violated the trust the citizens put in them.  The question to answer for the citizens is how can such behavior be prevented?

Corruption is the illegal use of legitimate authority.  Any behavior that abuses and therefore crosses the parameters of one’s power can be classified as corruption.  Corruption applied to a police force entails the robbing of drug dealers, redirecting of contraband into the personal accounts of officers, perjuring ones self to protect a corrupt officer, falsifying police reports, planting drugs to frame citizens, and a host of other misconduct that violates the oath of protecting the people.  In the 39th precinct in Philadelphia the five officers were officially convicted for lying on police reports, misappropriating drug bust funds, and framing innocent victims of drug possession.  These convictions have led to sixty overturned cases of false drug charges.  Of the victims, besides Betty Patterson, was an eighteen-year old nursing student who both plan to sue the department.  However, this sort of corruption is not exclusive to Pennsylvania, New York, and Louisiana, which suggests that there might be something inherent about police work that causes a given officer to break the law.  I submit that part of it can be attributed to officer training, and budgetary incentives.

    3. Rationalizing Corruption

       

       

                  It happened in Officer Serpico’s department, it happened in the 39th Precinct, it happens in Ohio, New Orleans, Los Angeles, all across the United States.  Police take money from the drug bust and line their pockets with it.  The number of known federal, state and local law enforcement officers in prison has increased five fold from 1994 to 1998; 107 imprisoned in 1994 to a high of 548 in 1998(Nelson, Jack and Ronald J. Ostrow,  “Illegal Drug Scene Spurs Rise in Police Corruption”).  It appears that officers cannot resist the temptation to increase their pay.  They look at the dealers, they look at themselves, and then they look at the money; it becomes rational for them to have a piece of the pie.  When the U.S. President declares a war on drugs and the police are on the side of the righteous, it does not take a big leap to understand that they think it unfair for the enemy to keep all the spoils.  It is this type of thinking that police succumb to everyday.  Though they cannot be blamed for being tempted, they should be blamed for acting on those temptations.  Yet there is another rationalization that the rank-and-file officers use, budgetary incentives created by the chief.

                  Certain incentives exist for police officers to arrest more drug dealers and to plant evidence on those suspected of knowing were drug deals occur. These incentives exist in the form of supplementing the annual budget, which translates into better equipment, higher success rates in convictions, and possibly higher wages.  When the equipment manager approaches the chief about the meager amount of funding in the budget allotted for equipment, and the chief retorts that he expects it to be made through drug busts; there exists a tremendous incentive to seize drugs contraband, legally or not.  Consider a simple analogy.  In high schools, teachers hand out detention assignments to students that misbehave.  Teachers use their discretion in deciding who gets detention and for what rule breach.  This discretion is at times based on the teacher’s mood.  Now imagine that there existed a monetary incentive for assigning detentions.  The number and rate of students receiving detentions would increase dramatically. At first, based on real rule violations, no matter how miniscule, and then, on to fabricated rule violations. Essentially, this abuse of power mirrors abuse of police power.

                  Now, officers see themselves behaving like this for the department, and they ask themselves why the department, and thus all its employees should be the only beneficiary when it is individuals that are in the trenches.  They do not disagree that the department should benefit from confiscated contraband, they just think that they should directly benefit also.  Policies like this can change perfectly honest, but insecure officers into average crooks. The challenge is to avoid such pitfalls.

The situation of police corruption, specifically policemen planting evidence, stealing contraband for their own personal accounts, and falsifying police reports, is tremendous.  I have outlined a few methods to curb the problem and firmly believe if these 6 ex phila narcs had been trained differently in the Academy and the field, screened more strictly, undergone ethics indoctrination, and were not faced with the incentive program the likelihood of them facing the situation they did, decreases tremendously.  Since corruption of this kind has existed in the police force since ad infinitum, it is conceivable that some or all of these methods have been attempted in some capacity.  Another answer, but one that I cannot construct, might be to change the entire ideology and system of policing and punishment.  That, I leave to prosperity.

  28. My lord that was a mouth full, and very informative- however, these 6 men are and will be found NOT GUILTY. COME ON,USE YOUR HEAD PEOPLE. Almost a decade of an investigation; numerous times trying to set these men up and you came up with nothing, NOTHING, EVERY LAST ONE of your witnesses has something to gain from these men being found guilty yet they all had ZERO proof of any wrong doing and the only ONE person you put on the stand who had nothing to gain ( because he was an under cover FED when you unsuccessfully tried to set these men up) his only complaint was that they used foul langue , over almost a decade span of time- the Feds were so stuck on the corruption in this unit and guess what, You already got it, and it only took one time to set that fool walker up and catch him red handed, but you guys wanted tommy because he's "cocky" and if you "federal investigators" we're as good at your job as he was at his ( dare I call you that due to the recent show you put on of showing us all your sub par "investigating skills" ) you guys might be cocky too!
    This was a pissing match that went to far and now it's time to LET.IT.GO. You lost the match, you pissed all over your shoes and when the NOT GUILTY verdict comes out on Monday I pray that the investigators on this case, every last one of you...has to Anwser to someone for what you have done to these men, these OFFICERS.

For some damn reason the anonymous haters refuse to understand that every witness was caught lying and that any evidence proving these 6 did anything wrong was not presented period. As for you anonymous who posted those several corrupt cases they all had one thing in common dirty police officers and audio and evidence supporting wrong doing and a paper trail.

      The same can be said about the federal prosecutors, lets start at the top. The feds were handed the same mandates on crime from the legislators that wanted to get tough on crime, mandatory sentencing and an arsenal of laws from the Rico Act to the Patriot Act, created for organized crime and terrorist ,now used regularly against average citizens.

      I read an interesting little article about a former Vietnam war activists, he said looking back, he would not have called the police pigs and treated the returning soldiers so horribly. We are doing the same exact thing, the police are the first contact with our judicial system which is horribly broken.

      I am sure even hall monitors abuse their power, any time someone is give power over another, the likelihood of misconduct is great. My amazement is that the public is so ready to believe the prosecutors who have the ultimate power over all of us, no one is questioning their motives. The judges, the FBI and the IRS are all the government. The over criminalization of America is what has turned this country into the civil unrest we are seeing now. Action on the part of the legislation is needed to reform mandatory sentencing. Federal prosecutors, with the help of the media, have turned the police, politicians and unions into criminals.

      Many here have cited police abuse but just as many incarcerated individuals if called could easily prove prosecutorial misconduct. The feds also believe their corruption is justifiable .

    Mayor Nutter vowed he would not allow the alleged actions of “six sick scumbags” to impact the reputations of officers who risk their lives everyday.
    The majority of officers in narcotics are hardworking,not corrupt period,” Ramsey said emphatically.     2. Krasno law firm is seeing a spike in calls because of its aggressive ad campaign towards drug dealers. They gave targeted heavily in North and West Philly claiming that they will get the drug dealers the settlement they deserve if they were arrested buy these men and even if they werent. Staff members have already left the firm because of their unethical practices. They get 40% of the settlement from the city so they are going after these cases for the money...not because they believe the officers did anything wrong.

    Testifying for the government: A dirty cop who got caught red-handed in an FBI sting operation walking out of a drug dealer's house with $15,000 and five pounds of marijuana. The drunk who showed up loaded at work, dozed off during stake-outs, and forgot where he left his gun. The thief who has admittedly lied on the stand dozens of times and convicted innocent people. The liar who cut a deal with the government, which depends on the testimony offered during this trial. But he's telling the truth.

    Also testifying for the government: A bunch of drug dealers full of outrageous stories and outlandish accusations.

    Meanwhile, over at the defense table sit six police officers Arch-criminal masterminds who knew how to placate the department brass with headline-grabbing busts while they beat and robbed drug dealers. Amoral, ruthless bandits with a badges so slick they supposedly knew how to hide the booty from the feds, elude sting operations and FBI accountants.

    The feds, already guilty of sloppy detective work can also be faulted for bad story-telling. The sloppiness of the feds' investigation in this case has been amptly demonstrated.

    On the eve of trial, the government had to drop a couple of counts from a 26-count indictment because one of their sleazeball witnesses got busted again, and because the feds didn't do their homework in checking out another sleazeball's story.

    Mistakes were made, an FBI agent admited on the stand. The defense called several of the cops' supervisors to the stand, witnesses that the feds never even bothered to interview.

    We didn't interview one lieutenant, an FBI agent testified, because we didn't think he would tell the truth. Or as the defense suggested, maybe it was because it was only your version of the truth that you wanted to hear.

    There are plenty of other lingering problems with the prosecution's case. If Tommy Licardello and the boys stole $500,000 from the drug dealers, as the feds have alleged, what did they do with the money?

    There's no paper trail on the alleged booty, or undercover video or audio evidence of cops getting caught red-handed. Just the word of Walker and a bunch of drug dealers all singing in the federal choir.

    If the jury believes Walker is credible, they have to swallow his story that he's the rare thief who's so lazy he never gets around to counting the money he stole. Can anybody buy that?

    If Tommy and the narcs are the criminals the feds say they are, why didn't they take the bait in an FBI string operation the way Jeffrey Walker did? Instead, the feds rolled the cameras and came up empty; the cops didn't take a dollar of planted dirty money. What does the jury do about that?

    If the feds were so convinced the six defendants were such corrupt officers, why didn't they keep running sting operations until they caught them red-handed like they did with Walker? The federal investigation of the six defendants had already gone on for eight years. Why didn't they keep it going until they finished the job?

    All the prosecution has besides Walker is a bunch of whiny drug dealers who say they were taken advantage of. The defense has produced a bunch of superior officers who testified that those busts were legit and that the defendants were hero cops. It helps their case when there's no booty to show off on surveillance videos, or paper trails leading to secret accounts where the loot was stashed.

    With the sleaziness of the prosecution witnesses and all the holes in the case, how can a jury convict these men?

Why have internal affairs, or have ethics boards if they don't or wont do the jobs they were designed to do.     I'd bet my last dollar This verdict will be not quilty, to the person above of course a hung jury is possible but the jury is still asking questions- if they are not asking anymore questions and still have no verdict then I would assume more towards a hung jury then I would right now.
    Praying again to have this over tomorrow for these 6 men.

  64. The case has many different facets. Do i believe some things did happen surely. Do i think the $ amount etc that the drug dealers said was stolen inflated yes I do. The govt star witness is pure scum. Did $ money go up the food chain in the unit. The question is did the govt prove their case beyond a reasonable doubt. NO. Did i think they get convict on somethings yes. John S walks
