An Open Letter To Judge Boccabella

An Open Letter to Judge John Boccabella:

We are encouraging you to give careful consideration in adjudicating the egregious miscarriage of justice in the misdemeanor case against Dr. Graham Spanier, the former President of the Pennsylvania State University.

In this misdemeanor case, any form of incarceration of Dr. Spanier, a 72 year-old, non-violent individual with no criminal history and serious medical conditions, serves only as vengeance and has no socially-redeeming value.

Due to Dr. Spanier’s medical conditions, specifically late stage cancer and substantive heart problems, recklessly exposing him to the inherent dangers of incarceration, which includes COVID, would be tantamount to a death sentence.

Notwithstanding Dr. Spanier’s extremely severe medical conditions, this case has been fraught with blatant prosecutorial misconduct, violation of constitutional rights, collusion, witness tampering and jury tampering accomplished by prosecutorial and investigative entities some of whom have since been disciplined for their actions in this case.

In addition, the jury foreman in Dr. Spanier’s trial has indicated that he wishes he would have acquitted Dr. Spanier. Another juror stated she was not convinced Dr. Spanier knew but voted against him because “he should have known;" both instances raise great doubt in regard to the jury decision.

This occasion affords you the opportunity to be on the right side of history in a misdemeanor case that should have never been brought.

  1. Favored elites, like Spanier, always miraculously have "severe illnesses" when faced with prison.
    He covered up horrific child sex abuse.
    He should be in prison.
    Big Trial protects and shi!ls for Spanier like the Inquirer protects the Curtis Institute's child raping Jascha Brodsky. And Gerry Lenfest, who helped cover up child sex abuse, while leading the Curtis.
    For some favored elites, there are crimes so bad as they should serve in prison.

      The person could not discuss the matter publicly and spoke to the AP on condition of anonymity.

      Silver was released Tuesday from a federal prison on furlough while he awaited potential placement to home confinement. The 77-year-old Silver had been in prison since August, where he was serving more than six-year sentence at a prison in Otisville, New York.

  3. OK Anonymous @ 846am - have it your way. Then where is Shapiro with all of the prosecutorial misconduct committed during Seth Williams tenure by ADA Sorenson. Missing notes, subpoenas ignored, etc. Shapiro and Krasner have advocated for KILLERS to get out of jail time. Do you support those "favored elites" Shapiro loves the camera and loves headlines. He protects nobody. Meanwhile Philly burns - 2 more shot dead last night. 500 here we come

      We used to -at least- acknowledge equal justice under the law.
      I don't know Spanier's religious beliefs, but i dont think he's a Catholic or Penn State were a Catholic institution. Or we wouldn't be reading all this sanctimonious deflection. And he'd had already served his time.and a stiffer sentence to be sure.
      Now it's all the justice money and connections can buy.
      Jim Kenney helped cover up massive fraud at the VisitPhilly Tourist bureau when in city council. Nothing happened to him or the elite fraudsters.
      Now Kenney's mayor! Hows that for accountability?

  4. If Judge Boccabella wrote you a letter back, he would simply say that it’s his duty to close the loop on the Sandusky case, regardless of feelings. He could not show ANY sympathy toward anyone connected to this case. That was never going to happen. Too many people have too much invested in this whole case to show any weakness of any kind. If you really thought that he would rule otherwise, you don’t get it either. The whole stinkin mess has got to get out of the Pa. court system in order for any truth to be heard. If you can’t see that, again, you don’t get it.

    1. The same can be said about you, the media condemned these people, as they do with all defendants, no one questions the accuracy of what is reported. The media is compromised by the prosecution prior to a trial.

      The prosecution consists of the prosecutors, FBI agents, IRS agents, and most importantly the media, who can be counted on to deliver the judge and the jury.

      The media has no idea of anyone's innocence or guilty, they carry the prosecutions version of details in a case. Most people get their facts from media outlets who are looking for a high profile case to boost readership, not the truth.

      Most journalists are very content with job they have done regardless if an innocent would spend a lifetime in jail. These same journalist who "fight corruption" are not interested in a defendants truth or the truth at all.

      This may come as a shock to you but prosecutors lie, FBI agents lie, IRS agents lie. Exculpatory evidence goes missing, witnesses lie because they or their families are threatened with jail time or financial ruin. The mainstream media does not get it hence neither do you.

    2. Think of Epstein, Weinstein. The DAs and in the case of Epstein, the United States Department of Justice, intervened to aid and protect the global child sex trafficker, ostensibly to protect the Clintons, Prince , Harvard, MIT, Leon Black, Les Wexner, others.
      For rich, powerful elites, many rarely are brought to justice. If they finally are, it's after years of favored treatment and victim silencing.
      We never got the truth on Epstein. We never will. Too many billionaires involved.
      They know how to cover it all up.
      Roman Polanski got an Oscar and a standing ovation. Whoopi Goldberg said what he did wadnt "rape-rape".

All they had to do was to have Spaniner evaluated by a doctor working for both the prosecutor and defense to see how sick he was and to come up with a medically certified plan to enable Spaniner to serve his two month prison term it is possible Spaniner will complain of medical illness and end up spending time in a hospital getting treatment the next two months or he will exit prison just fine.

    State Attorney General Shapiro sounds more like a whiny little boy crying to have Spaniner thrown in jail than a man enforcing the rule of law. He has no one to blame except himself as he could have easily allowed Spaniner to serve 4 months in house arrest to make up for the two months in prison. He knows he screwed up bad.
