Defense To Rely On Top Cops To Refute Drug Dealers

By Ralph Cipriano
for Bigtrial.net

It took four weeks for the government to finally run out of drug dealers.

After sending a parade of 15 drug dealers to the witness stand, the government this morning rested its case against six former narcotics officers accused of going rogue by allegedly  beating and robbing the suspects they busted.

The defense then began its case by calling FBI Agent Dennis Drum to the witness stand.

Defense Attorney Jack McMahon took Drum through a list of 15 superior officers and fellow officers in the case who supposedly were eyewitnesses to the various "episodes" of alleged police misconduct in the indictment.

Drum testified that a dozen of the cops were interviewed by the feds between three and seven months after the defendants in the case were indicted on July 30, 2014. Two of the cops were never interviewed; a third refused to talk.

The defense strategy seems to be to call as many of these officers to the witness stand as possible to refute the allegations made by the drug dealers who testified on behalf of the government. The list of possible witnesses include a chief inspector, an inspector, a captain, a couple of lieutenants, a sergeant, a corporal and some fellow officers.

If the boys in blue stick together, this case is going to come down to the FBI, Jeffrey Walker and a bunch of drug dealers vs. the Philadelphia Police Department.

Jack McMahon
The day in courtroom 15A began with a parade of FBI agents to the witness stand.

After Drum testified, the defense called FBI Agent Joe Ballesteri.

McMahon asked Ballesteri about allegations made by Victor Rosario, a former West Philadelphia marijuana dealer who testified on Thursday that the defendants had allegedly stolen a $5,700 Rolex watch from him, as well as a cache of jewelry allegedly purchased from Tiffany's.

McMahon asked Ballesteri if he visited Tiffany's and was able to find any evidence to substantiate Rosario's claims.

"I did not," Ballesteri testified.

Rosario also accused the defendants of stealing $8,700 that he had supposedly just received as a deposit on a construction job from a customer. On the witness stand, for the first time, Rosario named the alleged customer.

McMahon asked if Ballesteri if he was able to find any evidence to substantiate Rosario's claim about the $8,700 deposit.

"We attempted to verify it but we've been unsuccessful," the agent said.

He wasn't the last witness on the government payroll that was called to refute the claims of the prosecution's lineup of drug dealers.

John Simmons, a prison nurse, testified that when marijuana dealer Jason Kennedy came to jail, he did not have any visible wounds. Kennedy also signed a statement saying he had not been injured by the cops, Simmons testified.

On April 2nd, Kennedy testified that one of the defendants, former Officer Michael Spicer, had handcuffed the drug dealer and allegedly dangled him over a third-floor balcony rail. Kennedy told the jury that Spicer had allegedly punched him in the mouth, pushing a tooth through his lip. Kennedy testified that he also had a huge lump on the back of his head after he he was allegedly punched by Spicer and fell backwards on a hard tile floor.

But when Kennedy checked into prison on Feb. 25, 2010, Simmons testified, the nurse filled out a form that said the drug dealer didn't have any visible injuries. Kennedy also signed a form that said he did not have any police-related injuries.

Next, the defense called Chief Inspector Christopher Werner, who showed up in uniform and with a military-style buzz cut. Werner, a 26-year veteran of the police department, was the captain of the narcotics squad during some of the alleged episodes of misconduct.

Werner was asked about the case of Javier Blanco, a heroin dealer who claimed he was kidnapped by the defendants after they caught him with 234 grams of heroin, $6,900 in cash and an AK-47 assault rifle.

The defendants say that Blanco agreed to cooperate, and that their superior officers approved putting up Blanco at a hotel where he drank beer and shot pool with his alleged captors.

Werner testified that he was one of the superior officers who approved Blanco's stay at a city hotel. The district attorney's office was also consulted, Werner said.

Was Javier Blanco held against his will, McMahon asked the chief inspector.

"Absolutely not," Werner said.

While he was a captain, Werner testified, four of his officers were shot, including one close friend. Werner testified that he would never approve of any scenario that would place officers in jeopardy, such as holding a hostile drug dealer against his will.

"I just wouldn't do it," Werner testified.

Werner was also on the scene in November 2007 when the defendants, supposedly dressed in ski masks, lifted marijuana dealer Michael Cascioli off his feet and threatened to throw him off the balcony of his apartment on the 19th floor. Cascioli testified that the cops were all dressed in black the night they raided his apartment, and that the drug dealer thought the cops were mobsters out to rob him.

Werner was in the stairwell that day the cops raided Cascioli's apartment. The chief inspector testified that none of the defendants were wearing ski masks. The cops were also wearing protective vests that said police on them, Werner told the jury.

Werner recalled seeing former Officer Perry Betts holding Cascioli up against a wall. The chief inspector said he noticed that Cascioli was tense so he told the drug dealer he could relax, they were the police.

Was Betts using excessive force, Bettts's lawyer, Gregory Pagano, asked Werner.

"No," Werner said.

On cros-examination, the prosecutor asked Werner about whether drug dealer Blanco could have voluntarily walked away from the cops holding him at the hotel.

All Blanco had to do, Werner said, was tell the cops, "I don't want to cooperate any more."

The prosecutor asked Werner how the cops could justify letting a known heroin dealer like Blanco remain on the street. A guy who had been arrested with an AK-47 in his possession, a gun that according to an arrest report contained 30 live rounds.

"It was a misstep," Werner conceded. "He should have been arrested."

Defense lawyer Jack McMahon asked if Werner was aware that the information Blanco gave the cops resulted in four other busts of drug dealers. Werner, however, told the jury that he didn't know much about Blanco's work as an informant.

The case was a long time ago, Werner said.

The defense is expected to put on its case all of next week, Judge Eduardo Robreno told the jury at the end of the day. When the defense gets through, it will probably take two days for all the lawyers in the case to give their closing arguments, the judge said. Then, after the judge gives his instructions the case will go to the jury.

The prosecution had originally planned to call more drug dealers to testify as alleged victims. But one drug dealer was dropped from the case after he got arrested again for drugs; another was dumped after defense lawyers caught him allegedly perjuring himself in other court proceedings.

The loss of the two drug dealers from the government's case was the subject of a hearing, a couple of motions to dismiss, and a loud argument in court,

In contrast, a third drug dealer identified in the indictment as "J.L." was silently dropped from the witness list without any public discussion.

In the indictment, under "Episode #5," the government charged that former Officer Thomas Liciardello and other defendants allegedly broke into J.L.'s residence on Mercer Street on Feb. 7, 2008 and confiscated $24,600 in drug proceeds and an iPhone.

According to the indictment, Licardello allegedly authored a bogus police report that said only $8,600 in cash had been seized from J.L.'s apartment; the bogus report also didn't mention the stolen iPhone, the government charged.

J.L. was originally on the witness list but was dropped without any fanfare. The prosecution concluded its case today by not calling J.L. Surely at some point, the jury will have to be told about that.

Now that the government has rested its case, there's a few mysteries left to ponder.

In their original investigation of the defendants, how could the feds have left so many uncovered bases? How could they have not interviewed all the defendants' fellow cops, especially their superior officers, if the superiors were alleged eyewitnesses to some of the episodes and a party to some of the arrests?

Jeffrey Walker
The case, of course, will boil down to whether the jury believes Jeffrey Walker and the government's
stable of drug dealers.

The obvious problems with that strategy is that Walker is a train wreck, as one defense lawyer put it, and that the drug dealers have obvious credibility problems and factual discrepancies in their stories. And apparently no evidence to corroborate their allegations.

Another flaw in the case is that the drug dealers basically all told the same story on the witness stand over and over again, down to using the same words used to describe the alleged police behavior in the case. The cops ransacked my house, the drug dealers usually said. Except for the one guy who apparently misread the script and said his place was "ram-shacked."

There's plenty of evidence so far for a jury to convict Jeffrey Walker. He's the guy who got caught on camera in an FBI sting operation carrying $15,000 and five pounds of marijuana out of a drug dealer's house. But there's no incriminating undercover audio or video evidence against the defendants. Or any paper trail to implicate them.

Walker's going to be a continuing credibility problem for the feds.

On the witness stand today, defense lawyers took several FBI agents involved in the case through  "rough notes" of some of their 45 different interviews with Walker. With that much material to work with, there's bound to be factual discrepancies for the defense to pick on.

Such as the time Walker told the feds that when he was on the job as a cop, "I tried to be as honest as I could."

When Walker got caught planting drugs on a suspect in the FBI sting, he originally told the feds that it was the first time he'd ever planted drugs on anyone. When he appeared in court, however, Walker admitted that he'd planted drugs on people so many times he'd lost count.

Walker also told the feds, "I never stole and gave drugs to anyone."

On cross-examination, the FBI agents told the prosecutor that the statements the defense lawyers singled out were made within two weeks after Walker's arrest. The government is going to have to argue that it took a while for Walker to get around to telling the truth.

The defense will say he's still lying in an attempt to talk his way out of a life sentence.

The case resumes at 9 a.m. Tuesday.

  1. Several HUGE problems here . . .

FBI Agent Joe Ballesteri was questioned about the allegations made by Victor Rosario, a former West Philadelphia marijuana dealer who testified on Thursday that the defendants had allegedly stolen a $5,700 Rolex watch from him (that's already been proven to be a lie), as well as a cache of jewelry allegedly purchased for his former girlfriend from Tiffany's.

McMahon asked Ballesteri if he was able to find any evidence to substantiate Rosario's claims. "I did not," Ballesteri testified. Rosario also accused the defendants of stealing $8,700 that he had supposedly just received as a deposit on a construction job from a customer. McMahon asked if Ballesteri was able to find any evidence to substantiate Rosario's claim about the $8,700 deposit. "We attempted to verify it but we've been unsuccessful," the agent said.

Are you kidding me!! How the hell do you indict men on charges when you cannot verify that any of the information is true!!!

FBI Agent Denis Drum testified that the FBI interviewed about 12 of the cops who were eyewitnesses to the alleged police misconduct in the indictment. The problem is these twelve police officers were interviewed by the feds between three and seven months AFTER the defendants were indicted on July 30, 2014.

Wouldn't you interview eyewitnesses BEFORE the indictment is handed down so you can verify that the accusations in the indictment are true??

What the fuck is going on here??

    1. Apparently the Feds get to play by their own set of rules, which seems odd considering they are accusing these 6 men of doing just that. How this investigation was not shut down after YEARS of no physical evidence is mind blowing. How this got to trial is even more mind blowing, even with a not guilty verdict they have in some ways ruined these men's lives- how can someone justify that, with the circus that the Feds have been putting on in that court room for the passed three weeks. The people that did the investigation, the people that let this go to trial, should not just get to walk away Scott free. So that's a great question, What the F is going on here?

    2. What should happen is the FBI , three stooges need to be indicted then fired. They have personal vendettas against the 6 men. Shame on the US Attorneys office for sending this case to the Grand Jury. No jury will buy this mess. Salute to our men in blue.

    4. Its easy to indict anyone if you lie to a grand jury, you have the prosecution leading the jurors who were feed distorted ,erroneous lies. The government gets extra points just because they are the government and no one believes the government would lie to the American people. The jury thinks they are doing their civic duty by agreeing with the prosecutors. Hence they get their indictments. Easy really.

  9. The FBI and the media are just an extension of the prosecutors, the mainstream media is handed what the feds want in the paper to convict defendants before they even get to trial. I thought the FBI was supposed to be a fact finding ,neutral part of the judicial system. My idea of an FBI agent was one of honesty , integrity, a body sworn to protect the American people, nothing could be further from the truth. Watching the FBI agent lie in the Traffic Court trial was heart wrenching, all but one of the defense attorneys mentioned it in their closing arguments, but a room full of reporters and not one word about it in the media, not that day or any day after. Does the newspaper take its orders from the feds, when will the reporters get it. The feds are not GOD, they lie. With unlimited time and unlimited resources you would think the FBI would do the right thing since they are here to uphold justice. Its ironic that some went to jail for perjury, while the agent, walked away. He did his job, coached by the prosecutors. Audio tapes do not work that could help exonerate a defendant, witnesses crucial to a case are never interviewed. How can the FBI agents sell their souls, when does it stop. 302's need to be written in front of the person giving the statement and signed by the person to authenticate what was actually said. Not an agents version of what was said that is the norm now.

  14. Some of the high lights from Chief Inspector Tony Boyles letter .The implications surrounding this incident and transfer are profound. Nothing in my almost 39 year career has the potential for harm to my character and reputation. When I was removed from Southwest Police Division because of personal animosity toward me, for my refusal to change an accurate performance report of a personal friend of my Deputy Commissioner, I didn’t say a word or file a grievance. It didn’t affect my character or reputation, if anything it acted to reinforce my character and reputation.

This incident is the complete opposite. As I see commanders of all ranks, including mine, investigated for criminal acts, multiple EEO complaints, domestic incidents and incompetence, yet maintain their commands and, in some cases, be promoted; I can no longer remain silent. This transfer from T&ESB, during the height of funeral preparations for a fallen officer, intrinsically carries with it the message that I did something egregious surrounding the funeral and the honors for our fallen officer and his family, or I was insubordinate to my chain of command.

That message was sent without any investigation, any opportunity for me to present or explain my actions, nor any due process. It was sent on the basis of outright dishonesty and distortions and not based on the facts.

Werner – during testimony yesterday he told the prosecutor “as captain, I’m going to have to take responsibility” for the release of a drug dealer that the officers on trial are accused of abusing.

    1. I think most all the witnesses are telling the truth. Credibility is an issue with a few of them and I understand that. What I meant by saying if ONE witness is telling the truth, meaning that even if they only stole and falsified documents ONE time they are guilty. For example you might not believe Rosario but you believe Kushner etc. Even if Rosario lied about the rolex, Kushner is telling the truth about the money that means Tommy and crew still broke the law and are still guilty of the charges. The jury can decide who is telling the truth and who isn't, but if reason to be believe the cops could or did steal and lie they are guilty as charged. In a RICO case the group is responsible for the actions of any individual in the case. Walker already admitted to it....JB and MT you guys got it all wrong. These cops will be found guilty,

If these 6 men did what the feds are accusing them of, and after almost a decade of being investigated there is NO ACTUAL PROOF? not ONE THING. I go to work everyday, my paycheck is direct deposited, I have receipts for any major purchases I have made and they are insured. I have never been in trouble with the law. However, I cannot go to the FBI or the police and just say that Joe Shmo stole 20k off of me and not have any proof of it and expect Joe Shmo to go to jail for the rest of his life. The burden of proof is on the ones making the accusation and there IS NO PROOF!

He gave Inspector Horne and Captain McCloskey a pass when they committed numerous felonies .Rank and file complained that if the allegations against Horne and McCloskey are true, they should have been charged with crimes including obstruction of justice, hindering criminal prosecution, conspiracy and tampering with evidence.

Lying to Internal Affairs investigators also is a fireable offense, according to policy. Ramsey has refused to release details of Internal Affairs' findings.

    2. Narcotics is a problem with corruption, What about the alleged theft at FIU was a potential federal crime, Magsam was never disciplined. According to the lawsuit, Lt. Testa discouraged cops in the unit from reporting the alleged theft.(Magsam resigned from the force in , a few months after cops removed 51 guns from his Northeast Philly home. Commissioner Ramsey talk about gun control . Commissioner you were wrong and also , made have cover up a crime .

Little, who worked in the FIU at the time of the alleged theft, reported it to Ramsey and Deputy Commissioners Richard Ross and Patricia Georgio-Fox in May 2010, according to the suit.An Internal Affairs investigation was launched, and Logan was put in charge of the case.

The lawsuit says that Logan determined that Testa and other top officials, including Heath and Blackburn, had orchestrated a coverup of Magsam’s alleged theft . Commissioner Ramsey play the mistake card again . Talk about cover ups Commissioner Ramsey is number one in that department . Some example Commissioner Ramsey and His Deputy Commissioners set .

    1. The problem in Philadelphia is The Pension fund of Philadelphia . We love our felons until they stop rewarding crooked Cops with life time pensions ,nothing will change . You want honest cops change the Pension law to include all felonies .

Look at Philadelphia Police Sergeant Robert Ralston on April 5, 2010 lied to police investigators about having been shot earlier that day by a man in the Overbrook section of this city. It is also a confirmed fact that the sergeant completely fabricated a story about having been shot by a “black man wearing cornrows” when the truth is that he premeditatedly shot himself. In addition, it is a confirmed fact that Sergeant Ralston confessed to his racist lie and that on May 11 he was suspended with intent to dismiss.

He put Police Officers in harms way . He put the African America community on edge . He receives a life time Pension for committing felonies . The pension board is supposed to vote independent . Why did they violate the Law ? When to Tax Payers get Justice . What about the Police Officers who never tarnish their Badge . Pensions for good guys only

Sorry they FBI gave these drug dealers their 15 minutes of fame but it was for nothing. NOT GUILTY will be the verdict and the druggies and junkies will be back in jail before long.

  41. As the article states, "In their original investigation of the defendants, how could the feds have left so many uncovered bases? How could they have not interviewed all the defendants' fellow cops, especially their superior officers, if the superiors were alleged eyewitnesses to some of the episodes and a party to some of the arrests?" There is only one answer . . . they knew that the testimony of the fellow cops and superior officers would not corroborate the testimony of the drug dealers and the Feds would never have been aboe to get their indictment. So they just decided not to talk to them. It's pretty obvious. There is no evidence to corroborate their allegations!!!!

Walker has major, major credibility problems as do the drug dealers who testified. Also, every single witness brought forth by the prosecution had major factual discrepancies in their stories, which was pointed out by the defense.

Another big flaw in the case is that the drug dealers basically all told the same story on the witness stand over and over and over again, down to using the same words used to describe the alleged police behavior in the case. The cops ransacked my house, blah . . . blah . . . blah . . . the drug dealers usually said.

This was not an investigation, this was a railroad job. This was not about finding the truth, this was about getting an indictment, come hell or high water. This article speaks volumes about the shody investigative practices and the obvious coaching of witnesses.

    Shame on the FBI.

If you believe in Karma this is karma coming full circle. They may not be guilty of every charge but they are guilty of some. They crossed the line and broke their oath in the name of greed. When these jurors agree that there is beyond a reasonable doubt that these guys committed the accused crimes the only thing they will be sorry for is that they got caught. I see JB and MT correcting everybody's English, how's mine? If I disagree with you does that make me a piece of trash drug dealer?

    3. Your English is fine, your ability to read is apparently not fine. If you can not follow the case by reading the articles on bigtrial then maybe you should go down to the court room and listen to it for your self. Now i want you to stay there until the FEDS put up any form of evidence that these men did what they did. A group of criminals looking for a pay day or a get out of jail free card who can barely speak proper english let alone remember the "stories" they are supposed to tell or told to the grand jury and you expect us to believe them? Im all in favor of Karma and a fair trial but WHAT CAN PEOPLE LIKE YOU NOT UNDERSTAND THERE IS NO PROOF OF ANYTHING. Get out of here calling other people PATHETIC, pathetic would be bringing a case to trial with no evidence. PATHETIC is investigating a group of men for almost a decade and not finding any actual proof of wrong doing even when you tried numerous times to set them up. So, to answer your question....your English is fine, the rest of you is.....PATHETIC.
