Do Tapes Hold The Answer In Mob Trial?

It could be a tale of the tapes, and that might not be a good thing for the defense.

Jurors started their fifth day of deliberations in the racketeering conspiracy retrial of mob boss Joe Ligambi and his nephew George Borgesi by asking to hear replays of several tapes introduced by the prosecution during the eight-week trial.

And they ended the day by asking to hear a half dozen more.

The panel of 11 women and one man is due to resume deliberations at 9:30 tomorrow morning. Whether they have overcome the impasse cited in a jury note on Monday remains an open question.

What does appear clear is that the panel is working.

Most of the tapes played today were used by the prosecution to support the conspiracy charge that is at the heart of the case.

But the panel also asked to rehear a now infamous tape picked up on a Pennsylvania State Police wiretap in the late 1990s in which Borgesi is heard boasting and cackling about how he beat up and knocked out mob associate Angelo Lutz.

While that tape has little, if anything, to do with the conspiracy charge Borgesi, 50, is fighting, it was used by the prosecution to show the jury what authorities allege is Borgesi's arrogant and violent nature. The tape was first played in the 2001 racketeering trial in which Borgesi, Lutz, Joseph "Skinny Joey" Merlino and four others were convicted.

It was reprised and played again in the first Ligambi trial last year. Four defendants were convicted in that case, one was acquitted and the jury hung on charges against Ligambi and Borgesi, setting up the retrial that began in November.

The other tapes the jury asked to hear today focused on the charges against Ligambi. The prosecution alleges that "Uncle Joe" oversaw an organized crime gambling and loansharking operations. Government expert witnesses testified that money is routinely "kicked up" to the boss in a crime family.

While there was little evidence linking Ligambi, 74, directly to any criminal activity, there were tapes in which his role was mentioned.

On one tape replayed for the jury today bookmaker Gary Battaglini, who was convicted in the first Ligambi trial, is heard telling a deadbeat gambler that the money he owes goes to "Uncle Joe." On the same tape, Battaglini says that Ligambi doesn't care about anything, "he just wants his money."

The defense could take some solace, however, in another tape in which Joseph "Scoops" Licata, the only defendant acquitted in the first trial, is heard praising Ligambi as a boss who never asks for anything. Earlier in the same tape, recorded at a North Jersey restaurant, Licata introduced Ligambi to several New York mobsters as "acting boss" of the Philadelphia mob.

In tapes played at the end of today's session, the jury heard Michael Orlando, who was wearing a wire and cooperating with the FBI, discussing his gambling debts with mobster Damion Canalichio and, on another tape, with mob underboss Joseph "Mousie" Massimino. Canalichio and Massimino  were also convicted in the first trial.

The defense has portrayed Orlando as a drug addicted degenerate gambler and less than credible witness. The conversations played today centered on debts of about $9,000 that Orlando owed to various mob figures.

The defense contends Orlando used the FBI to pay off some of those debts and then hid behind the protection of the federal government to avoid paying the rest.

In a discussion with Canalichio, Orlando explained how he was having trouble coming up with the money he owed. Canalichio, in reply, said, "It's not my money," adding that it was Ligambi's.

"It's Uncle Joe's?" Orlando asked nervously.

On another tape, however, Canalichio refers to "Stevie's money," an apparent reference to mob capo Steven Mazzone. The defense has argued repeatedly that many of the debts discussed on tapes played for the jury were money owed to Mazzone, not Ligambi.

The prosecution, however, says that as boss Ligambi had a piece of everyone's action.

That could be the question the anonymously selected jury was wrestling with as it headed home after its fifth day of deliberations.

    7. Enough already.. This jury clearly doesn't have a solid verdict to pass down... This is the second trial as this 74 year old man has sat in prison away from his family. For some alleged gossip. Even on tapes... It doesn't mean anything is true. If you are born and raised in Philly or even know how many people from south philly are.. You'll know that the rumor mill churns and people throw your name in crap.
      It's a circus. And a waste of tax payers dollars. Leave the man alone. He wasn't alleged to have hurt anyone. And clearly this jury have their answer.
      We can't help who we are related to. Or what reputations people have developed for them over the years. So family stands by each other. And in south philly. Every is cuz. Even friends... ARE FAMILY.
      A fair trial... Joe Ligambi had.. The jury was split...
      Lucky in south philly people don't judge you.

No, it's not gossip and no some of isn't true - Not all of it, but enough of it is. If you are actually family I sympathize. But blame him- for his choices, for his words, for his actions. Keep in mind that the FBI, A General have reached all time low. They have used witness's with very, very tarnished accusations. Knowing their questionable validity the Feds continued full press. Disregarding the financial burden on the taxpayers and the justice system. Everybody wants to jump on attack mode on the defendants, especially George and his mother and brother. Some people have make comments that he is the worst. Well have you noticed what the government is abusing its power like a so-called "gangster" just get their promotion?!?? He has done his time, and did it with more style than most people would. Just look how the Feds have been conducting themselves. Him an his family are frustrated with the Feds playing with there heads and making stories up along with their PAID informants! They may of said things that peopl don't think is right , but how many others who been in situations with Feds and they were nasty arrogant to them, like spitting on them, calling them names etc??? You can never predict who will withstand their punishment like a man. That's why it's best to go to work.     1. As I read this blog site, I don't recall them saying a last name. Just someone named " Stevie" . That was the tapes speaking for themselves, the Feds made the tapes so they have the info without it being intruduced by any party. The guy talking on the tape should of known better, but how was he to know he was being recorded. Just saying a name doesn't mean a pointing a finger if they play it in court they may need it to show its inconsistency and showing that no one person is a alleged "boss", so it dismisses any allegations that the uncle allege boss receiving monies. If the gentleman stated in those recordings was on trial it would help him, vice versa. Two names are spoken so who is the allege boss.? Dismissed.! By no means a "rat" move. Good attorney work.   42. Can someone explain how Uncle Joe could have lived a pretty nice lifestlye of simple bookmaking. I see high end rollers going through more legitimate sources of betting and the nickle and dimers would only seek the mob. Same with the loansharking, how much could possibly be made from that with the knowledge today of being caught?

  83. You people are a bunch of uneducated, unthinking group if you think for a second that someone should "rot in jail for the rest of their life" for poker machines. Poker machine that you all played. Or football bets that you all made. Or them lending money to people who can't go to the bank for it. That's just horrible isn't it. You would all get a slap on the wrist, just probation, nothing more. But joe should get life. Let the punishment fit the crime.

    The best part is there is still no proof that he had anything to do with it. It is innocest until proven guilty for a good reason. You all think he's guilty because you "heard it on the news or from George A ... Well then it must be true, right? You all have no facts, just what people have said "this is what you should believe". There is nothing here. Nothing. You have no facts at all, beside the speculation you read in the paper.

    How come not one person doesn't think it's a crime that an innocent man has spent a couple of years of his life in prison for poker machines. What if he's found innocent. Or better yet what if he actually is. What kind of justice is that that the Feds can come in and say, "oh you were given bail by the judge, well we won't allow that". You can be next to have your rights stripped from you. You better hope that it doesn't happen to you.
